Import plan and confirmation of import
duty-free of FDI enterprises
On 28th November 2006, the
Ministry of Trade issued Official Letter No.7400/BTM-KHDT on abolishing the
approval of import plan and confirmation of import duty-free of FDI
enterprises.
Accordingly, the Departments of Trade and Boards of Management of High-tech
Zones, Export Processing Zones and High-tech Zones shall not approve the
import plans; not certify exemption of import tax imposed on machineries and
equipment creating the fixed assets, not approve import plan of materials
serving for investment projects; not certify assets liquidation and other
licensing procedures relating to import-export activities of the investors.
Besides, the Official Letter stipulated
that the foreign investors (including those were issued Investment Licenses
before 31 December 2005 and have completed procedures for approval of import
plan and certification of import tax exemption by the agencies who are
authorized by the Ministry of Trade) shall be allowed to directly carry out
procedures for goods import-export and assets liquidation at the Customs
border without approval document of the agencies who are authorized by the
Ministry of Trade.
The foreign investors shall take full
responsibilities for declaring import exemption procedures and submitting tax
exemption dossier to the customs agencies.
